DMCA & Intellectual Property Policy for Orthfy

Pursuant to Title 17, United States Code, Section 512 (Digital Millennium Copyright Act), we respond expeditiously to legitimate notifications of claimed copyright infringement processed by our designated team.

1. Notice of Infringement (DMCA Takedown Procedure)

Comprehensive contact information for the claimant, including legal entity name, primary physical address, direct phone line, and an official corporate/professional email address.
A written statement asserting that you have a “good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
A statement made under penalty of perjury confirming that the facts provided in your notification are accurate, valid, and that you hold full legal authority to execute the complaint.

2. Safe Harbor Compliance & Limitation of Liability

Orthfy operates as an online digital platform and educational distributor. Under 17 U.S.C. § 512(c), Orthfy qualifies for operational Safe Harbor protections. You acknowledge and agree that Orthfy shall not be held liable for monetary damages, prospective profits, or statutory legal fees resulting from digital uploads or automated listings, provided that our administrative team acts promptly to disable access to or remove disputed content upon receiving a valid, fully substantiated notice.

3. Resolution Timeline & Voluntary Removal

We investigate all verified IP inquiries with priority. Our compliance team commits to reviewing, processing, and executing actions on valid takedown requests within 24 to 48 business hours. Once validated, access to the contested material is immediately suspended across all operational servers.

4. Misrepresentation and Bad-Faith Notices

Under 17 U.S.C. § 512(f), any party who knowingly misrepresents that digital material or platform activity is infringing shall be held liable for all corresponding financial damages, including legal fees incurred by our team or operational partners. Orthfy retains the full right to seek damages against frivolous, automated, or bad-faith claims filed without substantiated evidence of ownership.

5. Counter-Notice Protocols

If a digital asset or study guide was disabled as a result of an erroneous report or misidentification, the original contributor may submit a formal counter-notification containing statutory identification, a statement submitted under penalty of perjury regarding the legitimate origin of the file, and consent to legal jurisdiction in relevant federal courts.

6. Repeat Infringer Policy

In strict adherence to DMCA guidelines, Orthfy maintains an operational repeat-infringer policy. We reserve the authority to permanently restrict system access, cancel customer accounts, or discontinue vendor associations involving any party identified as a repeat subject of substantiated infringement notifications.
