OUR AGGREGATE MONETARY LIABILITY CONCERNING ANY DISPUTE OR CLAIM TIED TO THE SERVICES SHALL UNDER NO CIRCUMSTANCES EXCEED THE TOTAL CONSIDERATION REMITTED BY YOU TO ORTHFY WITHIN THE PRECEDING SIX (6) MONTHS, OR $50.00 USD, WHICHEVER REPRESENTS THE LOWER FIGURE.

11. Indemnification

You agree to defend, indemnify, and hold harmless Orthfy and its operational agents against any external claims, legal judgments, financial liabilities, or legal costs arising from your misuse of the platform, unauthorized duplication of our study assets, or violation of these Terms.

12. Governing Law and Exclusive Jurisdiction

All questions concerning the validity, construction, and performance of these Terms shall be governed by the laws of the State of Wyoming, United States, without regard to choice of law principles. Any legal proceeding arising directly or indirectly from this agreement shall be instituted exclusively within state or federal courts situated in Sheridan, Wyoming, USA.

13. Discretionary Arbitration

Orthfy reserves the sole election to direct any unresolved customer controversy or interpretation dispute to definitive, binding arbitration managed under the rules of the American Arbitration Association (AAA) conducted within the United States.

14. Severability & Entire Agreement

Should any individual clause be adjudicated invalid by a court of competent jurisdiction, the remaining sections preserve complete legal force. These Terms, combined with our Privacy Policy, Medical Disclaimer, and Refund Policy, embody the unified operational understanding between the parties.
